Michigan Bankruptcy Attorney

Do you need an experienced Michigan bankruptcy attorney?
Hogan & Kipke can offer you the relief from debt and peace of mind through chapter 7 or chapter 13 bankruptcy. We offer comprehensive evaluations for both personal and business bankruptcies.

The primary purpose of the bankruptcy laws are to give an honest debtor a "fresh start" in life by relieving the debtor of most debts, and to repay creditors in an orderly manner to the extent that the debtor has the means available. During the pendency of a bankruptcy proceeding, the debtor is protected from creditors bringing court action. The creditor will only be permitted to continue collections through the bankruptcy court.

In southeast Michigan, the United States Bankruptcy Court is headquartered in downtown Detroit.

Bankruptcy in the United States is a matter placed under federal jurisdiction by the United States Constitution. Michigan bankruptcy law is found in both federal and Michigan statutes.. State law can play a major role in many bankruptcy cases. Often, it is quite unwise to generalize bankruptcy issues across state lines.

The most common types of personal bankruptcy for individuals are Chapter 7 and Chapter 13. Chapter 7 allows for liquidation of most types of debts while Chapter 13 proceedings are intended to allow for the debtor to set up a payment plan. Under the new rules of the 2005 Bankruptcy Reform Act, the law became far more stringent. It is now more difficult for people to qualify for Chapter 7 bankruptcy if their income over the preceding six months, multiplied by two, exceeds the median annual income of individuals who live in comparably sized households in the same state. You need a competent attorney to evaluate your case.

If debts have overwhelmed you, then it is time to consider bankruptcy.

Hogan & Kipke, P. C. serves all of Southeast Michigan for all of your bankruptcy needs. Contact us today for a consultation to find out how we can help.
